Navigating the regulations for Tiny Homes on Wheels (THOWs) and Park Models in Florida requires understanding a critical distinction between state and local laws. Florida's regulatory environment is a "patchwork," with no single statewide law permitting THOWs as full-time residences on private residential land, making it critical to research where to legally place a tiny home in Florida before you begin. The state legally classifies Tiny Homes on Wheels (THOWs) as Recreational Vehicles (RVs). This designation is the most crucial factor, as it dictates that they must comply with vehicle registration and are generally restricted to locations zoned for RVs, such as campgrounds and mobile home parks.

While the state has adopted Appendix Q into the Florida Building Code (FBC) to provide construction standards for tiny homes under 400 square feet, this applies only to homes built on a permanent foundation. These structures may be permitted as Accessory Dwelling Units (ADUs) in certain cities and counties, but this does not legalize living in a wheeled unit in a backyard. The most viable and common path for full-time THOW living is within some of Florida's best tiny home communities to live in or RV parks that are specifically zoned to allow long-term residency, such as those found in progressive cities like Rockledge, FL.

  • Statewide Classification: THOWs are defined as Recreational Vehicles under Florida Statute § 320.01. This means they are regulated by the Department of Highway Safety and Motor Vehicles, not local building departments, and are typically restricted to RV-zoned parks.

  • Homes on Foundations: Tiny homes built on permanent foundations are legal to construct under the Florida Building Code's Appendix Q. However, their placement is subject to local zoning ordinances, which may permit them as ADUs in some areas like Sarasota or Pasco County.

  • Agricultural Land Use: A common misconception involves placing tiny homes on agricultural land. A 2024 bill (SB 1082) that would have eased these rules was vetoed by the Governor. Currently, there is no statewide permission for this; it remains under strict local county control and is often prohibited.

  • Park Models & Wind Zones: Florida allows Park Model RVs up to 500 sq. ft. (larger than most states) but imposes strict installation and tie-down requirements to withstand Wind Zone II & III hurricane-force winds, especially in coastal areas. Properly building a hurricane-ready tiny home for Florida is crucial for safety and compliance.
