This classification prohibits their use as permanent, full-time dwellings on private residential land.   • Foundation is the Legal Path: The most secure way to live in a tiny home is to build it on a permanent foundation, following codes like Kauai County's Ordinance 1066, which adopted IRC Appendix Q. THOWs and Park Models are treated as RVs and are illegal for permanent habitation.
  • Agricultural Housing Rules: Building on agricultural land is possible but requires demonstrating legitimate farm use. Maui County requires proof of $35,000 in gross agricultural sales for a farm labor dwelling, while other counties require a detailed Farm Plan.
