This is the critical distinction from a Park Model RV, which, despite a similar appearance, is legally considered a recreational vehicle and often restricted by local ordinances to seasonal use (typically 120-180 days) in designated parks. While state law is permissive, municipalities retain authority over local regulations like property setbacks, septic system requirements, and aesthetic standards. The adoption of IRC Appendix Q into the state building code also provides a clear pathway for constructing tiny homes with features like lofts and ladders.

  • Statewide Right-to-Place: Under LD 1530, municipalities cannot prohibit a tiny home from being placed as a primary residence or an Accessory Dwelling Unit (ADU) on a lot zoned for single-family homes.
  • Titling is Key: The legal protections for year-round living only apply if the structure is officially titled as a "Tiny Home" with the Maine Bureau of Motor Vehicles. Without this title, it is treated as an RV and subject to occupancy time limits.
