Navigating the regulations for Tiny Homes on Wheels (THOWs), Movable ADUs, and Park Models in Santa Clara requires understanding a critical jurisdictional distinction: rules in Unincorporated Santa Clara County are progressive, while those in the City of Santa Clara are far more restrictive. The County has embraced movable tiny homes as a viable housing solution, whereas the City primarily treats them as recreational vehicles with strict limitations on habitation. This split approach means a property's specific location is the single most important factor in determining what is permissible.

In unincorporated areas, the County allows one Movable Tiny Home (MTH) per lot as a legal Accessory Dwelling Unit (ADU), provided it meets specific standards. This includes being registered with the DMV, built to ANSI 119.5 (Park Model) code, and connected directly to water and sewer utilities. For those on agricultural land, state and local laws also provide pathways for "Temporary Agricultural Residences" to house workers. In contrast, the City of Santa Clara prohibits living in a THOW or RV on private residential property and enforces a 72-hour parking limit on public streets. The City's use of "tiny homes" is almost exclusively for government-managed interim housing projects for the unhoused.

  • City of Santa Clara Restrictions: The City generally prohibits habitation in wheeled structures on private property. Its ADU ordinances focus on permanent, fixed structures. Living in a vehicle is restricted by the city's 72-hour parking ordinance.

  • State Law Framework: California state law empowers local governments to allow MTHs as ADUs but does not mandate it. This discretion is why the County has adopted a permissive ordinance while the City has not.

  • Community Options: Dedicated tiny home communities are rare. The Garlic Farm RV Park in Gilroy is the most notable option, actively converting lots for tiny homes. Most other "tiny villages" are city-sponsored transitional housing, not for private ownership.
