Instead, regulations are highly decentralized. At the state level, these movable dwellings are legally classified as Recreational Vehicles (RVs), not permanent homes. This places them under the jurisdiction of the Texas Department of Motor Vehicles (TxDMV) for titling and registration, rather than housing authorities. Park Model RVs, specifically, must be built to the ANSI A119.5 standard to be accepted in most communities. The primary distinction for legal placement is between incorporated cities and rural county land. Most major cities like Austin, Houston, and San Antonio prohibit living full-time in an RV or THOW on a private residential lot, restricting them to licensed RV parks. However, a growing number of these parks have rebranded as "tiny home communities." The most permissive environment exists in unincorporated county areas, which generally lack zoning authority. This "county loophole" makes rural placement on private land the most straightforward path, provided the owner can meet crucial health and safety requirements, most notably installing an approved On-Site Sewage Facility (OSSF), or septic system.

  • Placement & Permitting: The most viable options are placing a THOW on private land in an unincorporated county or leasing a spot in a dedicated tiny home village or RV park. In rural areas, the main permit required is for a septic system.

  • Municipal Restrictions: Within city limits, occupying a THOW outside of a designated park is typically a code violation. The most common solution is a tiny home community that operates under an RV park license.

  • Pioneering Communities: Some municipalities are creating specific ordinances to embrace this housing type. Lake Dallas established a dedicated tiny home village ordinance, and Spur, TX, has rules allowing tiny homes once they are placed on a foundation.

  • Agricultural Land: While an "ag exemption" provides a tax benefit, it does not waive county rules for septic systems or utility hookups. Housing for agricultural workers is regulated separately and must meet specific health standards if multiple workers are housed.
